Nevada Medical Marijuana Laws in Question

Like many states, Nevada is currently experiencing a lot of confusion in relation to its medical marijuana laws. It seems to be a common occurrence these days as lawmakers seek to heavily restrict laws that were recently passed by majority voters.

The main focus of these restrictions seems to be the medical marijuana dispensaries, which provide patients with the drug. This is the case with Nevada, which allows patients to possess medical marijuana but still makes the buying and selling of marijuana illegal.

A judge, Donald Mosley, faced with these facts was forced to throw out a case last week, stating that the laws surrounding the issue were “mind-boggling.” In order to get around the legality of buying and selling, distributors, such as the charged Leonard Schwingdorf, have been forced to set up a system of donations, offering medicine in exchange for a monetary contribution.

This system did not satisfy law officials, however, who are claiming that it doesn't meet the intent of the law preventing buying and selling. The judge was not in the same mindset, however, as he stated “Are people supposed to give it away? I mean it just makes no sense.”

The medical marijuana community agrees, as many supporters around the country shake their heads at cases like these. It is flabbergasting that lawmakers are still seeking to punish those involved with medical marijuana, despite popular support from their constituents.

We are happy to hear that this case was thrown out, but that doesn't mean that the distributor in question cannot be re-indicted. It is important that the community continue to show support for individuals in these situations, and keep letting officials know that medical marijuana is a very real part of this country's present and future.
